Just two-and-a-half weeks before his sex-with-minors trial is due to start in a West Palm Beach courthouse, former WPTV-Channel 5 weatherman Rob Lopicola asked the judge to throw out incriminating statements he made when he was arrested!
It’s another Gossip Extra exclusive you won’t find in The Palm Beach Post: Lopicola, who’s staring at 20 years in the big house for allegedly having sex with two boys too young to consent, now says West Palm Beach cops who grilled him after his July 2012 arrest didn’t let him call an attorney!
While the other evidence against him is considered overwhelming, Lopicola could score big if Judge Stephen Rapp agrees to strike Lopicola’s statements to police.
Neither Lopicola’s public defender nor prosecutors commented on the motion.
Court papers obtained by Gossip Extra show that Lopicola may have intended to call his father to ask him to hire an attorney but instead talked to police for more than an hour.
If nothing else, some of the allegations made against police by Lopicola attorney Kristy Militello indicate a lot of confusion from Lopicola’s part.
The muscle-bound weatherman did hear a Miranda warning advising him that anything he says can be held against him.
But what came next was alleged game-playing by cops who changed topic, gave him the wrong advise and/or claimed ignorance when Lopicola brought up calling a lawyer.

“Mr. Lopicola was denied his right to counsel which he requested on many occasions,” Militello wrote in her motion.
Lopicola’s jury trial is scheduled to start Oct. 21. He’s been unable to pay his bail and has been in jail since his arrest.
