David Prather DUI: The Incident Report

High-profile lawyer David Prather reeked of liquor early Sunday morning when a trooper and a West Palm Beach Police officer helped him clear his disabled Porsche from I-95, according to the incident report obtained by Gossip Extra.

Prather was described as “laughing and smiling a lot” by the trooper who also reported that Prather’s eyes were glassy and bloodshot, and didn’t follow his finger smoothly during a field sobriety test.

Prather, 47, also failed the one-leg stand and other tests at the scene, even though he told the trooper that he teaches how to administer field sobriety tests. Prather’s practice includes auto negligence.

Prather’s car had stalled on the center lane of the northbound highway, near the Hypoluxo exit, when cops first saw him.

He told the trooper he was on his way home from a (South Palm Beach County) Bar Association party in Boca when he first noticed engine trouble.

He told cops he had just two glasses of wine and two of water.

Prather refused a Breathalyzer test, according to the report, and was charged with DUI.

    He uses the excuse that he has asthma not to take the breathalyzer test? is that some lawyer trick? and of course refuses to take a blood test- is that for religious reasons??
    I am sure he will have a great excuse for failing the field sobriety tests. Wait & see

      Jeff, the article says that he REQUESTED a blood test and the officer refused. A blood test is way more accurate than a breathalyzer. It shows Prather was more than cooperative. Why wouldn’t they take his blood, as HE requested?

    David is a good guy. It looks like he made a bad choice, but so have each of us – lawyer, MD, teacher, cop, etc. It is easy to condemn some one for a bad decision but hard to praise someone for a lifetime of good deeds. Fortunately no one was injured and I am sure he, and everyone reading this article will learn from his mistake, right? Probably not as many of you who are critical of him will make that same mistake this sat nite as you leave the bar, stumble to your car and drive home. Best wishes to you David and please know you have friends supporting you. Keep your chin up as you have a lot to be proud of!

    The problem with DUI is that it is so easy for people like Friend to dismiss it as a “bad choice” and to then try to minimize it by pointing the finger at others. Blame displacement helps no one and I suspect Friend is really talking about his/her own driving proclivities. To a certain extent, DUI is a bad choice, but it is also a reflection on the true nature of a person that thinks only of themselves. There are families with children and other completely innocent people on that road including the officers that made the arrest. Mr Prather was only thinking about himself when he made the choice to drive. I am sure he was more worried about his car than he was about killing other human beings. And I am sure the car means more to him. Actions do speak louder than words. A lifetime of good deeds means nothing. Again, like blame displacement that is a transparent attempt to lessen the crime. The crime and the defense of the crime will all be about “me, me, me”. The same thought process that caused the DUI in the first place. I hope Mr. Prather finds out what the true problem is.

    Jose- How about an update on the Prather DUI arrest? The initial defense arguments put forth by his lady lawyer were nonsense.

    I hope this hack doesn’t try DUIs; any knowledgeable criminal defense attorney would know that FSTs are not mandatory and would not have submitted to them!
